Terms of Service

InstantMowingQuote ("the Service," "the Platform," "we," "us") is a web-based lawn-care quoting tool built by Mike Andes as a personal side project. The Service is currently in beta and is provided on an experimental, as-is basis. It is powered by artificial intelligence and third-party APIs and is hosted on cloud infrastructure that is not operated by Homeworks or any related entity.

The Service is intended to help lawn-care business owners generate instant price estimates for their customers. All prices generated are estimates only and should always be verified with an on-site assessment before a final quote is given to any customer.

As used in these Terms, "Released Parties" means Mike Andes, Copilot Software LLC, Augusta Franchise LLC, Mike Andes Media Group LLC, and each of their respective officers, directors, employees, agents, successors, and assigns. All protections, limitations of liability, disclaimers, and indemnification obligations in these Terms apply equally to each of the Released Parties.

InstantMowingQuote is a personal project of Mike Andes and is not supported by the Homeworks engineering, product, or customer support teams. The Homeworks support channels — including live chat, email support, and scheduled calls — are not available for assistance with InstantMowingQuote. Any reference to Homeworks within the Service is solely for the purpose of verifying that users hold an active Homeworks Enterprise subscription, which is used as an eligibility criterion for access.

All support inquiries for InstantMowingQuote must be directed to Mike Andes personally at [email protected] and are handled on a best-effort basis with no guaranteed response time or resolution. None of the Released Parties — including Copilot Software LLC, Augusta Franchise LLC, or Mike Andes Media Group LLC — have any obligation to provide support for this Service.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED AVAILABILITY. THIS DISCLAIMER APPLIES TO ALL RELEASED PARTIES, INCLUDING BUT NOT LIMITED TO MIKE ANDES, COPILOT SOFTWARE LLC, AUGUSTA FRANCHISE LLC, AND MIKE ANDES MEDIA GROUP LLC.

Mike Andes is not a professional software engineer and makes no representations or warranties regarding the quality, reliability, security, or suitability of the Service for any particular purpose. The Service may contain bugs, errors, inaccuracies, or interruptions. Features may be added, changed, or removed at any time without notice. The Service may be discontinued at any time at the sole discretion of Mike Andes.

You acknowledge that you are using beta software and that your use of the Service is entirely at your own risk.

None of the Released Parties — including Mike Andes, Copilot Software LLC, Augusta Franchise LLC, or Mike Andes Media Group LLC — promise to fix any bugs, errors, or defects in the Service. There is no service level agreement (SLA), guaranteed uptime, or committed support response time. Any assistance provided is voluntary and at Mike Andes's sole discretion. By using the Service you waive any claim against any Released Party arising from the failure to fix bugs or provide technical support.

The Service uses artificial intelligence and machine learning models to analyze property data and generate pricing estimates. AI-generated outputs may be inaccurate, incomplete, or inappropriate for a given property. You are solely responsible for reviewing all AI-generated estimates before presenting them to your customers. None of the Released Parties — including Mike Andes, Copilot Software LLC, Augusta Franchise LLC, or Mike Andes Media Group LLC — are liable for any financial loss, customer dispute, or business harm arising from reliance on AI-generated pricing.

By using the Service you agree that we may collect and store the following categories of data:

• Account information: name, email address, and password (stored as a one-way hash).
• Property data: addresses, satellite imagery analysis results, turf square footage estimates, and pricing calculations generated during your use of the Service.
• Customer lead data: names, email addresses, phone numbers, and addresses submitted by your customers through embedded quote forms you create on the Service.
• Usage data: feature interactions, form submissions, scan logs, and session information.

We do not sell your data or your customers' data to third parties. Data may be shared with third-party service providers (such as cloud hosting, email delivery, and analytics platforms) solely for the purpose of operating the Service. Data is stored on cloud infrastructure and is subject to the security practices of those providers.

You are responsible for obtaining any necessary consent from your customers before collecting their personal information through embedded quote forms. You represent and warrant that your use of the Service complies with all applicable privacy laws, including but not limited to the California Consumer Privacy Act (CCPA) and the General Data Protection Regulation (GDPR) where applicable. None of the Released Parties shall be liable for your failure to comply with applicable privacy laws.

We implement reasonable technical measures to protect data stored on the Service. However, because the Service is a personal beta project hosted on third-party cloud infrastructure and built with AI assistance, we cannot guarantee absolute security. You acknowledge that:

• No method of transmission over the internet or electronic storage is 100% secure.
• The Service has not undergone a formal third-party security audit.
• In the event of a data breach, the Released Parties will make reasonable efforts to notify affected users but do not guarantee a specific notification timeline.

You agree to use a strong, unique password for your account and to keep your login credentials confidential. You are responsible for all activity that occurs under your account. None of the Released Parties — including Copilot Software LLC, Augusta Franchise LLC, or Mike Andes Media Group LLC — shall be liable for any damages arising from unauthorized access to your account resulting from your failure to maintain credential security.

Backup Retention. When you delete your account or request deletion of your data, we will remove your data from active production systems within 30 days. However, residual copies of your data may persist in encrypted automated backup snapshots for up to an additional 30 days following deletion from production systems. These backup copies are not actively accessed, used, or shared, and are permanently purged on the normal backup rotation cycle. Deletion requests are therefore considered fulfilled once data is removed from active production systems, consistent with standard industry practice.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NONE OF THE RELEASED PARTIES — INCLUDING MIKE ANDES, COPILOT SOFTWARE LLC, AUGUSTA FRANCHISE LLC, MIKE ANDES MEDIA GROUP LLC, OR ANY OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUCCESSORS, OR ASSIGNS — SHALL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, LOSS OF CUSTOMERS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ANY RELEASED PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL THE TOTAL AGGREGATE LIABILITY OF ALL RELEASED PARTIES TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU HAVE PAID TO USE THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS (USD $100.00).

THE LIMITATIONS IN THIS SECTION APPLY TO ALL THEORIES OF LIABILITY, INCLUDING CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, STATUTE, OR OTHERWISE, AND SHALL SURVIVE ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY.

No Liability to End-Customers or Homeowners. The Service is made available exclusively to lawn-care business operators ("Users"). The Released Parties have no contractual relationship with, and owe no duty of care to, any homeowner, property owner, or other third party who receives a quote generated through the Service, whether through an embedded form, a shareable quote link, or any other delivery mechanism. Any claim by a homeowner or end-customer arising from a quote, pricing estimate, or any other output of the Service must be directed solely to the User who deployed the Service — not to any Released Party. You agree to indemnify and hold harmless all Released Parties from any such third-party claims.

You agree to indemnify, defend, and hold harmless each of the Released Parties — including Mike Andes, Copilot Software LLC, Augusta Franchise LLC, Mike Andes Media Group LLC, and each of their respective officers, directors, employees, agents, successors, and assigns — from and against any and all claims, demands, actions, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation, including privacy laws; (d) any claim by a third party, including your customers, arising from your use of the Service; or (e) any data you collect, store, or process through the Service.

This indemnification obligation survives termination of your account and these Terms.

You agree not to use the Service to:

• Violate any applicable law or regulation.
• Collect or harvest personal data from other users without their consent.
• Attempt to gain unauthorized access to any part of the Service or its infrastructure.
• Reverse engineer, decompile, or disassemble any portion of the Service.
• Use the Service for any purpose other than legitimate lawn-care business quoting.
• Resell, sublicense, or otherwise commercialize access to the Service without written permission from Mike Andes.
• Take any action that could damage the reputation of any Released Party, including Mike Andes, Copilot Software LLC, Augusta Franchise LLC, or Mike Andes Media Group LLC.

All content, design, code, and materials comprising the Service are the intellectual property of Mike Andes and/or the applicable Released Party unless otherwise noted. You are granted a limited, non-exclusive, non-transferable license to use the Service for your own business purposes. You may not copy, reproduce, distribute, or create derivative works from the Service without prior written consent from Mike Andes.

Mike Andes may, at his sole discretion, choose to integrate or transfer this Service into the Homeworks platform or any other product operated by a Released Party at some future date. Any such integration would be announced separately and would be subject to the applicable terms of service of the receiving platform. There is no commitment, timeline, or guarantee that such integration will occur. Your use of this Service does not create any entitlement to future features, integrations, or pricing.

By using the Service, you hereby release, waive, and forever discharge each of the Released Parties — including Mike Andes, Copilot Software LLC, Augusta Franchise LLC, Mike Andes Media Group LLC, and their respective officers, directors, employees, agents, successors, and assigns — from any and all claims, demands, damages, actions, causes of action, or suits of any kind or nature, known or unknown, arising out of or in any way connected with your use of the Service, including but not limited to claims arising from data security incidents, AI-generated pricing errors, service interruptions, or loss of data.

If you are a California resident, you expressly waive the protections of California Civil Code § 1542, which states: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."

The Service uses a credit-based access system. A free account is required to use the Service. Registration is free, requires only a name and email address, and no credit card is required.

Trial accounts (registered users without a verified Homeworks Enterprise membership) receive a one-time allocation of 50 free credits. These credits are a lifetime total and do not reset monthly or on any periodic basis. Once all 50 trial credits are consumed, access to new quote generation requires a verified Homeworks Enterprise membership.

Regardless of credit balance, all registered accounts retain full access to: saved quote history, lead tracking and status management, the Quote Form Builder, website embed functionality, and CRM/webhook integration. The credit limit applies only to new address lookups and quote generation.

Homeworks Enterprise members receive 100 credits per month, which renew automatically on the 1st of each calendar month (Pacific Standard Time). Unused credits do not roll over.

Mike Andes reserves the right, at his sole discretion and at any time, to modify the credit allocation, introduce fees, subscription plans, or other charges for access to the Service or any portion thereof. Any future pricing changes will be communicated in advance via the Service or by email.

All fees paid, if any, are non-refundable except as required by applicable law. You acknowledge that you are not entitled to a refund, credit, or compensation of any kind for: (a) any period of service interruption or downtime; (b) removal of features or functionality; (c) termination of your account for violation of these Terms; or (d) your decision to stop using the Service. Your access to the Service does not create any vested right to continued access at any particular price point.

Mike Andes reserves the right to modify these Terms at any time. Changes will be posted to this page with an updated effective date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.

Informal Resolution. Before initiating any formal dispute, you agree to contact Mike Andes at [email protected] and provide a written description of the dispute. The parties will attempt to resolve the dispute informally for at least 30 days before either party may initiate arbitration.

Binding Arbitration. If the dispute is not resolved informally, you and Mike Andes agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service — including questions of arbitrability — shall be resolved exclusively by final and binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, as modified by these Terms. The arbitration shall be conducted in Washington State, or by telephone or video conference at either party's election. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Class Action Waiver. YOU AND MIKE ANDES EACH AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. IF FOR ANY REASON A CLAIM PROCEEDS IN COURT RATHER THAN IN ARBITRATION, YOU AND MIKE ANDES EACH WAIVE ANY RIGHT TO A JURY TRIAL AND WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT.

Exceptions. Either party may seek emergency injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration. Claims of intellectual property infringement may be brought in court.

Severability. If any part of this arbitration clause is found unenforceable, the remainder shall continue in full force and effect.

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Washington, and you consent to the personal jurisdiction of such courts.
